This book is the first contemporary entire research on the decisions of the ECJ and their legal effects. It includes a full analysis of the structure of the ECJ decision, its publication, the protection against null and inadmissible judicial decisions of the ECJ. The legal effects of the ECJ decisions are dealt with in their two principal aspects. On the one hand, the author analyses the question if the ECJ decisions constitute a source of law. He defends the view that only those ECJ decisions which create, amend or terminate the applicability of a legal norm are a source of law. On the other hand, the object of the book is the analysis of the legal effects of the ECJ decisions ratione temporis and ratione personae in the different ECJ proceeding, as well as their enforcement. |
